These Terms of Service (“Terms”) govern your access to and use of roaslytics.com (the “Site”), operated by Roaslytics (“Roaslytics,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is

The Site presents information about Roaslytics' growth-marketing services for direct-to-consumer ecommerce brands and lets qualifying businesses apply to work with us. Site content is provided for general informational purposes, is not professional advice (legal, financial, medical, or otherwise), and may change or be removed at any time without notice.

Applications and engagements

Submitting an application does not create a client relationship, engagement, or agency obligation of any kind. We review applications at our discretion and may decline any application without providing a reason. Any services engagement begins only when both parties sign a separate written services agreement, and that agreement — not these Terms — governs the engagement, including scope, fees, and deliverables.

You agree that the information you submit in an application is accurate and that you are authorized to submit it on behalf of your business.

Product previews

The Site may describe or preview software we are developing, including “The Compound.” Previews are pre-release, shown with sample data, and are subject to change or cancellation. Nothing on the Site is a commitment to release any feature or product, or a representation of results any product will deliver.

No guarantee of results

Marketing outcomes depend on many factors outside anyone's control. Nothing on the Site — including descriptions of our system, process, or metrics such as ROAS, MER, or CAC — is a promise or guarantee of revenue, growth, or any particular result.

Intellectual property

The Site and its content — copy, design, graphics, logos, and marks — are owned by Roaslytics or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to access the Site for its intended purpose. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.

Acceptable use

You agree not to:

— Use the Site in violation of any applicable law;
— Submit false, misleading, or unauthorized information through our forms;
— Scrape, harvest, or collect data from the Site by automated means;
— Interfere with the Site's operation, attempt to bypass security or rate limits, or introduce malicious code;
— Impersonate any person or entity.

Third-party services

The Site may link to or rely on third-party websites and services we do not control. We are not responsible for their content, availability, or practices.

Disclaimer of warranties

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROASLYTICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold Roaslytics harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maine, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version; continued use of the Site after changes take effect constitutes acceptance. If any provision is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and Roaslytics regarding the Site.
